Mishkat al-MasabihHadith Number 2967
وَعَنْ جَابِرٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «الْجَارُ أَحَقُّ بِشُفْعَتِهِ يُنْتَظَرُ لَهَا وَإِنْ كَانَ غَائِبًا إِذَا كَانَ طَرِيقُهُمَا وَاحِدًا» . رَوَاهُ أَحْمَدُ وَالتِّرْمِذِيُّ وَأَبُو دَاوُدَ وَابْنُ مَاجَهْ. والدارمي
Jabir Narrated from:
The neighbour is most entitled to the right of option and its exercise should be waited for even if he is absent, when the two properties have one road.” Ahmad, Tirmidhi, Abu Dawud, Ibn Majah and Darimi transmitted it.
