Authentic Hadiths on Non-Muslim Inheritance in Islam

These authentic hadiths clearly explain the Islamic rules regarding inheritance between Muslims and non-Muslims. As reported by Usama bin Zaid, the Prophet Muhammad (ﷺ) explicitly stated that a Muslim cannot be the heir of a disbeliever, nor can a disbeliever inherit from a Muslim. This fundamental ruling is further supported by the narration of Abdullah ibn Amr ibn al-'As, which clarifies that people belonging to two different religions are not entitled to inherit from one another. Additionally, the textual evidence touches upon real-world historical applications, such as the Prophet (ﷺ) noting how his property was affected because of family members who did not accept Islam, confirming that property lines follow religious ties. According to Islamic scholars, these clear guidelines maintain distinct boundaries for estate distribution based strictly on shared faith.

O Messenger of Allah, will you stay in your house in Makkah?” He said: “Has ‘Aqeel left us any houses?” 'Aqeel had inherited Abu Talib along with Talib. Neither Ja'far nor 'Ali inherited anything because they had been Muslims, and 'Aqeel and Talib had been disbelievers. So on account of that, Omar would say the believer does not inherit from the disbeliever. And Usamah said: the Messenger of Allah (ﷺ) said "The Muslim does not inherit from the disbeliever nor the disbeliever from the Muslim."
