حَدَّثَنَا أَحْمَدُ بْنُ حَنْبَلٍ، حَدَّثَنَا إِسْمَاعِيلُ، ح وَحَدَّثَنَا مُسَدَّدٌ، أَنَّ حَمَّادًا، وَعَبْدَ الْوَارِثِ، حَدَّثَاهُمْ كُلُّهُمْ، عَنْ أَيُّوبَ، عَنْ أَبِي الزُّبَيْرِ، - قَالَ عَنْ حَمَّادٍ، وَسَعِيدِ بْنِ مِينَاءَ، ثُمَّ اتَّفَقُوا - عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ نَهَى رَسُولُ اللَّهِ صلى الله عليه وسلم عَنِ الْمُحَاقَلَةِ وَالْمُزَابَنَةِ وَالْمُخَابَرَةِ وَالْمُعَاوَمَةِ - قَالَ عَنْ حَمَّادٍ وَقَالَ أَحَدُهُمَا وَالْمُعَاوَمَةِ وَقَالَ الآخَرُ بَيْعِ السِّنِينَ ثُمَّ اتَّفَقُوا - وَعَنِ الثُّنْيَا وَرَخَّصَ فِي الْعَرَايَا .
Jabir b. 'Abd Allah Narrated from:
The Messenger of Allah (ﷺ) forbade muhaqalah, muzabanah, mukhabarah, and mu'awanah. One of the two narrators from Hammad said the word mu'awamah, and other said: "selling many years ahead". The agreed version then goes: and thunya, but gave license for 'araya.
[1] Referring to unused land which a man gives to another man who spends on it, and cultivates it, then (the owner) takes some of its produce in return.[2] Selling years ahead, and it preceded.[3] That is, it was narrated via three narrators, and one of them, Hammād, heard it from Abū Az-Zubair, and Said bin Minā', so one of them and the other, refers two these two.[4] An exception of something for sale, the amount of which is not known.Reference : Sunan Abi Dawud 3404In-book reference : Book 23, Hadith 79English translation : Book 22, Hadith 3397
