حَدَّثَنَا أَبُو سَلَمَةَ، يَحْيَى بْنُ خَلَفٍ حَدَّثَنَا عَبْدُ الأَعْلَى، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ بْنِ جُنْدَبٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ " إِذَا أَتَى أَحَدُكُمْ عَلَى مَاشِيَةٍ فَإِنْ كَانَ فِيهَا صَاحِبُهَا فَلْيَسْتَأْذِنْهُ فَإِنْ أَذِنَ لَهُ فَلْيَحْتَلِبْ وَلْيَشْرَبْ وَلاَ يَحْمِلْ وَإِنْ لَمْ يَكُنْ فِيهَا أَحَدٌ فَلْيُصَوِّتْ ثَلاَثًا فَإِنْ أَجَابَهُ أَحَدٌ فَلْيَسْتَأْذِنْهُ فَإِنْ لَمْ يُجِبْهُ أَحَدٌ فَلْيَحْتَلِبْ وَلْيَشْرَبْ وَلاَ يَحْمِلْ " . قَالَ وَفِي الْبَابِ عَنْ عُمَرَ وَأَبِي سَعِيدٍ . قَالَ أَبُو عِيسَى حَدِيثُ سَمُرَةَ حَدِيثٌ حَسَنٌ غَرِيبٌ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ وَبِهِ يَقُولُ أَحْمَدُ وَإِسْحَاقُ . قَالَ أَبُو عِيسَى وَقَالَ عَلِيُّ بْنُ الْمَدِينِيِّ سَمَاعُ الْحَسَنِ مِنْ سَمُرَةَ صَحِيحٌ . وَقَدْ تَكَلَّمَ بَعْضُ أَهْلِ الْحَدِيثِ فِي رِوَايَةِ الْحَسَنِ عَنْ سَمُرَةَ وَقَالُوا إِنَّمَا يُحَدِّثُ عَنْ صَحِيفَةِ سَمُرَةَ .
Samura b. Jundub Narrated from:
The Prophet (ﷺ) Said: "When One Of You Comes Upon Livestock, If Its Owner Is With It Then Seek His Permission. If He Permits Him Then Let Him Milk It And Drink. If There Is No One With It Then Call Out Three Times, If Someone Answers Then Seek His Permission. If No One Answers Then Let Him Milk It And Drink Without Carrying (Any Of It Away)."[He Said:] There Are Narrations On This Topic From Ibn 'Umar And Abu Sa'Eed. [Abu 'Eisa Said:] The Hadith Of Samurah Is A Hasan Gharib Sahih Hadith. This Is Acted Upon According To Some Of The People Of Knowledge, And It Is The View Of Ahmad And Ishaq. [Abu 'Eisa Said:] 'Ali Bin Al-Madini Said: "It Is Correct That Al-Hasan Heard This From Samurah." Some Of The People Of Hadith Criticized The Narrations Of Al-Hasan From Samurah, They Said That He Only Narrated From A Writing Of Samurah.

Summary of Jami at-Tirmidhi Hadith 1296
This Hadith teaches care for property, need, and permission. Samurah bin Jundab reports that if someone comes upon livestock and the owner is present, he should seek permission. If permission is given, he may milk and drink. If no one is present, he should call out three times. If someone answers, he should seek permission. If no one answers, he may milk and drink, but must not carry any away. The repeated condition is important: drink, but do not take extra. Abu Eisa grades the report Hasan Gharib Sahih and notes that some people of knowledge acted upon it.
What we learn from this hadith
- Permission should be sought when the owner is present.
- If no one is present, the person should call out before milking.
- The report allows drinking but forbids carrying milk away.
