43/13. Chapter:
The owner of the right has the permission to demand his right
وَيُذْكَرُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَيُّ الْوَاجِدِ يُحِلُّ عُقُوبَتَهُ وَعِرْضَهُ». قَالَ سُفْيَانُ عِرْضُهُ يَقُولُ مَطَلْتَنِي. وَعُقُوبَتُهُ الْحَبْسُ.The Prophet ﷺ said, "The delay in the payment of debt by one who can afford to pay, justifies his defamation and torture by the lender." Defamation means that the lender tells him in public that he has delayed the payment. Torture means legal imprisonment.

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى، عَنْ شُعْبَةَ، عَنْ سَلَمَةَ، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ ـ رضى الله عنه ـ أَتَى النَّبِيَّ صلى الله عليه وسلم رَجُلٌ يَتَقَاضَاهُ فَأَغْلَظَ لَهُ فَهَمَّ بِهِ أَصْحَابُهُ. فَقَالَ " دَعُوهُ فَإِنَّ لِصَاحِبِ الْحَقِّ مَقَالاً ".
Narrated Abu Huraira: A man came to the Prophet (ﷺ) and demanded his debts and used harsh words. The companions of the Prophet wanted to harm him, but the Prophet (ﷺ) said, "Leave him, as the creditor (owner of the right) has the right to speak."
